Proposal for new Consumer Sales Act submitted

In the legislative council's submission, the government proposes a new Consumer Sales Act that applies to purchases of goods as well as digital content and digital services. The proposal aims to adapt Swedish law to two EU directives and includes clearer rules for assessing defects in digital content. It is also proposed to extend the deadline for the reversed burden of proof when purchasing goods, i.e. the seller is responsible for proving that a defect did not exist at the time of purchase.

– The new rules represent an important strengthening of consumer protection in an increasingly digitalized consumer market. By clarifying the rules and requirements that exist for digital content, uniform protection is created even when consumers purchase, for example, streamed products or services, says Minister of Civil Affairs Lena Micko.

The new law is proposed to enter into force on March 1, 2022.
