Registered with ARN? Consider the following!
ARN is a committee consisting of 5 people. The judge who presides over the hearing has at least appellate court expertise. The rest of the committee consists of 2 business representatives and 2 consumer representatives. 2-4 of these people are often lawyers, but must also have expertise in their product area. APPLiA's representatives in ARN are Kent Oderud and Matts Spångberg.
All cases in ARN are decided solely on the basis of written documents; oral hearings are never held. ARN is also not allowed to conduct its own investigations that can form the basis for decisions. In most cases where the consumer is awarded a right, it is rarely due to a technical defect in the product, a so-called original fault, but most often it is because the trader has not documented service measures, failed to attach documents or has not responded to any of the consumer's claims.
Tips for your company's handling of notifications to ARN:
- If possible, appoint someone who is always responsible for the company and who is thus familiar with the procedures for ARN.
- Always respond on time.
- Please note that ARN only makes decisions on documents submitted in writing.
- Uncontested claims are taken as acceptance, so it is important to respond to all claims, even those that may seem unreasonable.
- Train internally about the importance of documenting service actions.
- Make sure that, for example, warranty terms, user manual, service report and photographic evidence are attached to the case, especially if you or the other party claims something that is supported by these.
