The Consumer Sales Act will change on March 1, 2022.
In the spring of 2022, changes will be made to the Consumer Sales Act as Swedish law is adapted to the EU's new rules on consumer purchases. Here, APPLiA has summarized the biggest changes.
The change comes from the implementation of the EU Consumer Rights Directive. The directive is a minimum directive meaning that the regulations will be different within the EU.
The biggest change is that the reverse burden of proof for original defect is extended from 6 months to 24 months. During year 3, the consumer has the burden of proof for original defect.
Sweden maintains a 3-year complaint period for original defects, of which during years 1 and 2 it is the seller's responsibility to prove that the damage is not original in order for the consumer's complaint to be rejected.
APPLiA's industry regulations will be updated in consultation with the Swedish Consumer Agency as soon as the legislation is formally decided.
