The Marketing Act will be revised on May 28, 2022

Here you can briefly read about the most important changes:

New information requirements:

– for marketing identical goods.
– for online marketplaces.
– for consumer reviews.
Prohibited marketing practices:
– Fake and manipulated consumer reviews/recommendations, e.g. by only publishing positive reviews.
– Claiming that a review comes from a consumer if this has not been verified.
– Lack of information about paid advertising.
– Unfair resale of advertising.
– Buy ”likes” on social media.

New requirements for price reductions

    In the event of a price reduction, the previous lowest price that was during a period of at least 30 days prior to the current price reduction shall be displayed.
  • Applies to sales of goods to consumers both online and in stores.
  • In the event of a gradual reduction, the price before the first reduction must be stated.
  • Exceptions for goods that may deteriorate or have a short expiration date.

New requirements for online sales

– Inform about whether prices have been personalized based on automated decision-making and profiling.

New requirements for distance purchasing

– The rules do not apply if the consumer has not undertaken to pay, i.e. in the case of gifts and free services.
– Changed rules on the right of withdrawal for digital services and digital content.
– Information must be provided about, among other things, possible means of communication via the Internet.
