ARN: Price error on Internet purchase of multiple vacuum cleaners – Request for completion of purchase

The customer placed an order for 3 vacuum cleaners at an 80 percent discount and received an order confirmation. The seller accidentally stated the wrong price and the order confirmation does not constitute a binding purchase. The seller canceled the confirmation the next day and informed the customer of the price error.

 

The seller believes that the customer was in bad faith over the heavily discounted price that was incorrect, which is also supported by the fact that the customer purchased 3 products. The customer has also accepted the terms of purchase which contain a reservation for obviously incorrect prices.

Based on the documents in the case, ARN notes that the order confirmation received by the customer does not indicate that a binding agreement has been formed.

ARN therefore rejects the customer's claim.
