Ethical rules

Information about APPLiA's ethical rules for contact and relationship-promoting benefits in business operations

Over time, different types of contacts occur between companies and people in companies, and as a result, questions always arise about the extent to which it is permissible to:

  • Trips, sales competitions, gifts and giveaways, etc.

The Institute Against Bribery has guiding ethical rules on its website that are based on the rules of the International Chamber of Commerce. www.institutetmotmutor.se There you can also get guidance on how to develop your own company policy.

For the public sector and its companies, the application is significantly stricter, such as imprisonment and exclusion from participation in procurement.

It is also important to point out that the legislation affects both donors and recipients.

From July 2012, all employees in the public and private sectors can be convicted of taking a bribe with imprisonment of up to 2 years.

When the court considers undue advantage, it looks at the following:

  • The nature and value of the benefit.
  • The connection between the benefit and the recipient's work or assignment.
  • The position of the recipient.
  • How the gift is delivered.
  • General custom or industry practice.

APPLiA has decided on ethical rules, which are attached. The rules are designed to support member companies. In cases where you are in doubt about your activity, APPLiA recommends that you read the entire text and let your activity be characterized by moderation. Below is also some advice to support companies.

When entering into agreements with partners:

  • Review your own company's or industry association's anti-corruption policy with the partner.
  • Feel free to include a clause in the agreement regarding the obligation to comply with anti-corruption legislation.
  • Please ask all partners as a standard that they have and demonstrate an anti-corruption policy.

Other advice/points to consider:

  • Keep in mind that improper benefits can consist of virtually anything.
  • The scope for offering, promising, giving, requesting, allowing oneself to be promised and receiving benefits within the framework of performing a job is very small.
  • Exercise great caution when dealing with benefits of a private nature.
  • Exercise great caution with all types of benefits during ongoing contract negotiations.
  • Check industry agreements and follow industry practices.
  • Ensure that the company has its own anti-corruption policy and that all employees receive training in what applies.
  • Representative convicted in a final judgment for bribery – can cost the company dearly because the company is subject to the rules in LOU/LUF bark be excluded from participation in a public procurement (also applies to municipal companies).
